Ala. immigration battle recalls civil rights past (AP)

MONTGOMERY, Ala. ? The epicenter of the fight over the nation's patchwork of immigration laws is not Arizona, which shares a border with Mexico and became a common site for boycotts. Nor was it any of the four states that were next to pass their own crackdowns.

No, the case that's likely to be the first sorted out by the U.S. Supreme Court comes from this Deep South state, where the nation's strictest immigration law has resurrected ugly images from Alabama's days as the nation's battleground for civil rights a half-century ago.

And Alabama's jump to the forefront says as much about the country's evolving demographics as it does the nation's collective memory of the state's sometimes violent path to desegregation.

With the failure of Congress in recent years to pass comprehensive federal immigration legislation, Arizona, Georgia, Utah, South Carolina and Indiana have passed their own. But supporters and opponents alike agree none contained provisions as strict as those passed in Alabama, among them one that required schools to check students' immigration status. That provision, which has been temporarily blocked, would allow the Supreme Court to reconsider a decision that said a K-12 education must be provided to illegal immigrants.

Its stature as the strictest in the nation, along with the inevitable comparisons of today's Hispanics with African-Americans of the 1950s and `60s, makes it a near certainty the law will be a test case for the high court.

"It really offers the Supreme Court a broad canvas to reshape what being an immigrant in the United States means," said Foster Maer, an attorney with LatinoJustice in New York, which is challenging the law.

Alabama was well-suited to be the nation's civil rights battleground because of its harsh segregation laws, large black population, and the presence of a charismatic young minister named Martin Luther King Jr., who led a boycott of segregated buses in 1955.

Opponents say the new law's schools provision conjures images of Gov. George Wallace's stand in the schoolhouse door to block integration.

"Today we have a different stand in the schoolhouse door. We have efforts to intimidate children who have a constitutional right to go to school," said Richard Cohen, president of the Southern Poverty Law Center.

Although no solid numbers exist, schools have reported fewer Hispanic students attending school, with some saying as much as 10 percent of their Hispanic students have withdrawn since the law took effect a month ago.

Illegal immigrants interviewed by The Associated Press have said their children were bullied and told to go back to Mexico, while others have described their intense fears of arrest and deportation.

The lawyer leading the state's defense, Alabama Attorney General Luther Strange, faults President Barack Obama's Justice Department for stirring the civil rights comparisons by falsely predicting the law would lead to the kind of widespread discrimination and profiling that marked Alabama's past.

"The idea they seem to have is there's a Bull Connor on every corner here in Alabama, which is so widely out of touch with our state," he said, referring to the public safety commissioner who unleashed police dogs and fire hoses on civil rights marchers in Birmingham in the 1960s.

At first glance, Alabama seems ill-suited to be the nation's immigration battleground. It's not a border state and is home to fewer illegal immigrants than several other Southern states.

"Why are we getting all the publicity? I think it has to do with Alabama's past and the perception that people have of Alabama over the years that don't live in our state and really don't recognize the amount of progress we've made in Alabama over the last 50 to 60 years," said Republican Gov. Robert Bentley, who advocated the law and signed it into effect.

Alabama's law, pushed through by a new Republican super-majority in the Legislature, is being challenged in federal court by the Justice Department, about 30 civil rights organizations and some prominent church leaders. Judges have blocked some provisions, but sections still stand that allow police to check a person's immigration status during traffic stops and make it a felony for illegal immigrants to conduct basic state business, like getting a driver's license.

State Rep. Alvin Holmes, the senior black member of the Legislature, said Republicans can't undo the voting rights gains of Democrat-leaning blacks, so they are going after brown-skinned people in hopes they won't gain a voting foothold. "They feel if these Hispanics come in and get registered to vote, they will team up with black voters to take over Alabama politics," he said.

Proponents say the law had nothing to with race. They say it was the result of frustration with the federal government's inaction and an effort to open up jobs for the nearly 10 percent of legal state residents out of work.

"There are people who try to make racism a cottage industry and profit off it, but I would put the harmony in Alabama up against any place in the country," said Republican Sen. Scott Beason, one of the law's sponsors.

Beason, the powerful chairman of the state Senate's Rules Committee, has prompted some of the comparisons with the civil rights era by telling one group that the Legislature needed to "empty the clip" on the immigration issue. And in tapes played during the federal trial of several lawmakers and lobbyists accused of buying and selling votes on gambling legislation, he referred to customers of a dog track in a predominantly black county as "aborigines."

Opponents of the law have fueled the comparisons by holding rallies at historic civil rights sites and drawing support from civil rights organizations.

No one in the Alabama Legislature was talking about immigration laws a decade ago because the Hispanic population was so small. The Pew Hispanic Center estimates the number of illegal immigrants in Alabama has grown from 25,000 in 2000 to 120,000 in 2010 ? a nearly fivefold increase ? though it's only a fraction of the 11 million or so estimated in the country.

That rapid rise drew complaints from residents who blamed Hispanics for knocking them out of jobs by working for cheaper wages and no benefits.

"They were coming in here like thieves in the night and taking our jobs and tax revenue," said Republican Rep. Micky Hammon, who also sponsored the new law.

To be sure, construction businesses and farms say Hispanic workers they have relied upon have fled the state. So far, they haven't been able to find legal residents willing to take on what is usually backbreaking work.

The governor said lawmakers in other states are eyeing Alabama's law as a blueprint for their own, but some fear that notoriety could come at a steep price: The state's image as an international automotive hub.

In 1993, a few months after state officials quit flying the Confederate battle flag on the Capitol dome, Mercedes selected Alabama for an assembly plant. Then came Honda, Toyota and Hyundai, and many auto suppliers.

The CEO of the state pension system, David Bronner, helped recruit those plants and now fears Alabama has hurt its ability to recruit.

"You are giving the image, whether it's valid or not, that you don't like foreigners, period," he said, adding that state leaders frequently seize on bad publicity to knock other states out of competition for new jobs.

That bad publicity has made its way to Hillsboro, Wis., where information technology businessman Charles Manser and 11 of his buddies have canceled a 10-day golfing vacation to Alabama.

Manser said one friend was born in Puerto Rico and another is a British citizen. They were concerned about being hassled over their legal status.

"Whether it's legitimate or not, that's the message seen by people who might come to Alabama," he said.

Smartron5 was backed by London listed private equity group Origo Partners PLC. Terms of the acquisition were not disclosed.

KBW cuts workforce after loss; CEO steps down (AP)

NEW YORK ? KBW Inc. said Thursday that it is reducing its workforce by 13 percent after reporting a surprising third-quarter loss. The investment bank also said long-time CEO John Duffy was stepping down after being diagnosed with prostate cancer

The New York company, which is known as Keefe, Bruyette & Woods Inc. and specializes in the financial services industry, blamed the disappointing quarter on the decline in bank and financial stocks.

For the three months ended Sept. 30, the company said it lost $15.7 million, or 51 cents per share. That's compared with a profit of $3.8 million, or 11 cents per share, in the year-ago period. Not including one-time items, the company lost 47 cents per share. Analysts on average had expected a profit of 2 cents per share, according to FactSet.

Quarterly revenue dropped to $50.4 million, from $89.6 million. The company lost $19.9 million from principal transactions, compared with a $12 million gain a year ago. Investment banking revenue fell to $32.1 million, from $38.4 million.

Revenue from commissions rose to $35.1 million, from $28.2 million. Although advisory fees from investment banking mergers and acquisitions rose, the company noted that activity was still "muted" amid concerns about asset values.

As part of a broader cost-cutting measure, the company noted that it began the process of cutting 80 of its 600 full-time positions in the quarter through layoffs and attrition. The company said it expects to record severance costs of about $5 million; $1.8 million was included the third quarter and the remainder is expected to be included in the fourth quarter results.

KBW also noted that it is reducing its use of consultants and temporary employees and trimming other non-compensation expenses.

Chief Operating Officer Thomas Michaud, 47, was named to succeed Duffy, who led the company for the past 10 years. Andrew Senchak, vice chairman and president, will take over Duffy's role as board chairman; Duffy, 62, will stay on the board as vice chairman.

The company declared a quarterly dividend of 5 cents per share.

Shares of KBW rose $1.22 per share, or 8.5 percent, to close at $15.50 Thursday.

Yungry, with emphasis on young

The Bucs entered this year with the youngest roster in football. While they have solidified their 10-6 record from a year ago in some ways, their incredible inconsistency speaks to their youth.

The Bucs have impressive home wins over Atlanta and New Orleans. They also have stinkbombs like the blowout loss in San Francisco and the lackluster effort in London against the Bears.

Sometimes the two sides of the Bucs come out in the same game, like the comeback win in Minnesota. You never know what you are going to get out of this 4-3 team. ?They can play a tight game with anyone, whether its the Saints or Colts.

Freeman?s foibles

No player symbolizes the up and down Bucs season more than quarterback Josh Freeman. He?s forcing too many passes, and starting games slowly. He?s throwing shorter passes and more interceptions. ?(His ten picks lead the league.)

Part of the issue is certainly Tampa?s receiver crew: Mike Williams, Preston Parker, Arrelious Benn, and Kellen Winslow don?t get a ton of separation. ?The bigger issue has been Freeman?s decision making.

Promising young defense

The Bucs envisioned their young defensive line leading the team. ?They are on their way. Rookie Adrian Clayborn is a keeper. Gerald McCoy was showing signs of improvement before he was hurt. ?Michael Bennett has quietly played well and rookie linebacker Mason Foster has seamlessly replaced Barrett Ruud.

Struggling secondary

The Bucs can be attacked through the air. Aqib Talib hasn?t had a great season. The same is true for cornerbacks E.J. Biggers and Ronde Barber. ?The Bucs don?t rank in the top 20 in points scored or allowed. They are 28th in yards allowed. ?They are -1 in turnovers. ?How is this team 4-3?

Tough schedule ahead

Six of Tampa?s final nine games are on the road. That starts with a huge road game in New Orleans, then a home game against the Texans before heading to Green Bay. ?It?s easy to see them 5-5 after ten weeks. The Bucs probably need to win in New Orleans for a realistic chance at winning the division.

The division schedule ends with road games in Carolina and Atlanta. Tampa has work to do before that finale truly matters.

This looks like a growing year for the Bucs, with 8-8 more likely than a playoff appearance.

HPV Vaccine Might Help Prevent Anal Cancers: Study (HealthDay)

WEDNESDAY, Oct. 26 (HealthDay News) -- A vaccine to prevent anal cancer is safe and effective for young gay and bisexual males, according to a study funded in part by the vaccine's maker.

Anal cancer is caused by human papilloma virus (HPV), the most common sexually transmitted disease in the United States. Anal cancer is particularly common among gay and bisexual men and people infected with HIV.

Merck's Gardasil vaccine is already approved and recommended as a way to protect women against the major HPV types that cause cervical cancer. The vaccine is also thought to protect against HPV strains that cause anal cancer and genital warts.

This week, the U.S. government's Advisory Committee on Immunization Practices recommended that boys be vaccinated against HPV.

"Almost six thousand people every year in [the U.S.] are diagnosed with anal cancer, and more than 700 people die from the disease," study leader Dr. Joel Palefsky, a professor at the University of California, San Francisco, said in a university news release. "What this trial showed is that those cancers and deaths could be prevented."

The international clinical trial included more than 600 gay and bisexual men who had had at least one, but no more than five, sexual encounters. The men, aged 16 to 26, were from Australia, Brazil, Canada, Croatia, Germany, Spain and the United States.

The participants received either the Gardasil vaccine (made by Merck) or a placebo and were followed for three years after they received the last of their three injections. The vaccine proved effective in reducing anal infections with HPV and reduced the incidence of precancerous anal lesions by 54 percent to 75 percent.

"Based on these data, the vaccine works well to prevent HPV infection and precancerous anal disease, and will likely prevent anal cancer in men," Palefsky said. "The ideal time to begin vaccination would be before initiation of sexual activity, but vaccination may also be useful after initiation of sexual activity."

One expert agreed that the vaccine can still be effective after the onset of sexual activity.

"The notion that HPV vaccines need to be given in childhood is slightly incorrect. The issue is that the vaccine [like all others] will work much better if it is given prior to the person being exposed to the virus. So, really it just needs to be given prior to the person becoming sexually active or, to be more precise, prior to the person having sex with someone infected with the HPV virus," said Dr. Ronald Ennis, director of radiation oncology at St. Luke's-Roosevelt Hospital Center in New York City.

He noted that "the study suggests it may help clear the infection in about 25 percent of people who were already infected prior to the vaccination, but I think that would need to be confirmed with more patients prior to being sure about that."

The study, funded by grants from Merck and the U.S. National Institutes of Health, is published in the Oct. 27 issue of the New England Journal of Medicine.

Fukushima Nuclear Plant Released Far More Radiation than Government Said

The disaster at the Fukushima Daiichi nuclear plant in March released far more radiation than the Japanese government has claimed. So concludes a study1 that combines radioactivity data from across the globe to estimate the scale and fate of emissions from the shattered plant.

The study also suggests that, contrary to government claims, pools used to store spent nuclear fuel played a significant part in the release of the long-lived environmental contaminant caesium-137, which could have been prevented by prompt action. The analysis has been posted online for open peer review by the journal Atmospheric Chemistry and Physics.

Andreas Stohl, an atmospheric scientist with the Norwegian Institute for Air Research in Kjeller, who led the research, believes that the analysis is the most comprehensive effort yet to understand how much radiation was released from Fukushima Daiichi. "It's a very valuable contribution," says Lars-Erik De Geer, an atmospheric modeler with the Swedish Defense Research Agency in Stockholm, who was not involved with the study.

The reconstruction relies on data from dozens of radiation monitoring stations in Japan and around the world. Many are part of a global network to watch for tests of nuclear weapons that is run by the Comprehensive Nuclear-Test-Ban Treaty Organization in Vienna. The scientists added data from independent stations in Canada, Japan and Europe, and then combined those with large European and American caches of global meteorological data.

Stohl cautions that the resulting model is far from perfect. Measurements were scarce in the immediate aftermath of the Fukushima accident, and some monitoring posts were too contaminated by radioactivity to provide reliable data. More importantly, exactly what happened inside the reactors ? a crucial part of understanding what they emitted ? remains a mystery that may never be solved. "If you look at the estimates for Chernobyl, you still have a large uncertainty 25 years later," says Stohl.

Nevertheless, the study provides a sweeping view of the accident. "They really took a global view and used all the data available," says De Geer.

Challenging numbers
Japanese investigators had already developed a detailed timeline of events following the 11 March earthquake that precipitated the disaster. Hours after the quake rocked the six reactors at Fukushima Daiichi, the tsunami arrived, knocking out crucial diesel back-up generators designed to cool the reactors in an emergency. Within days, the three reactors operating at the time of the accident overheated and released hydrogen gas, leading to massive explosions. Radioactive fuel recently removed from a fourth reactor was being held in a storage pool at the time of the quake, and on 14 March the pool overheated, possibly sparking fires in the building over the next few days.

But accounting for the radiation that came from the plants has proved much harder than reconstructing this chain of events. The latest report from the Japanese government, published in June, says that the plant released 1.5???1016?bequerels of caesium-137, an isotope with a 30-year half-life that is responsible for most of the long-term contamination from the plant. A far larger amount of xenon-133, 1.1???1019?Bq, was released, according to official government estimates.

`Paranormal 3' scares up record $54 million debut (AP)

LOS ANGELES ? "Paranormal Activity 3" didn't just go bump in the night. It made a ton of noise at the box office with a record-setting, $54 million opening.

The third film in Paramount Pictures' low-budget fright franchise, which was No. 1 at the box office, had the biggest debut ever for a horror movie, according to Sunday studio estimates. It broke the previous record part two set a year ago with $40.7 million. It's also the biggest opening ever for an October release, topping the $50.35 million Paramount's "Jackass 3D" made last year.

"Paranormal Activity 3" is actually a prequel, with the discovery of disturbing home-movie footage from 1988. Henry Joost and Ariel Schulman, who made the creepy documentary "Catfish," took over directing duties this time.

Don Harris, Paramount's president of distribution, said the studio hoped part three would simply perform better than part two. The first "Paranormal Activity," with its reported $15,000 budget, became a phenomenon in 2009 through midnight screenings and word of mouth.

Harris believes this installment did so well because it's actually the best movie of the three. He noted that it appealed to an older crowd, with 47 percent over the age of 25 compared to 40 percent for "Paranormal Activity 2." Strong reviews also helped, he said, including a rave from Time magazine. And fundamentally, horror movies simply play better in a packed theater.

"Ultimately, it gets back to why there's still a theatrical business, why people still go to the movies," Harris said. "We want to laugh in a group, we want to be scared in a group, people like to cry in a group in the dark where nobody can see them crying. It's all the reason movie theaters exist and this genre has always been front and center."

Paul Dergarabedian, box-office analyst for Hollywood.com, said he was expecting "Paranormal Activity 3" to come in around $35 million for the weekend, simply because most newcomers have been underperforming this fall.

"This brand is as solid as the `Twilight' brand or the `Jackass' brand. There are certain brands that just transcend any kind of box-office rhyme or reason. They just resonate," Dergarabedian said. "These are shot in someone's house, they look like they're shot with a home video recorder, and people just relate to it."

Last week's No. 1 release, the futuristic boxing robot adventure "Real Steel," fell to second place. It made $11.3 million for a domestic total of $67.2 million. Worldwide, the Disney movie has grossed $153.3 million.

Among the other new releases this week, Summit Entertainment's 3-D version of "The Three Musketeers" came in fourth place with $8.8 million. And Universal's "Johnny English Reborn," a sequel to the 2003 spy parody starring Rowan Atkinson, opened at No. 8 with $3.8 million. But it's already a huge hit internationally, having made $104.5 million so far.

In limited release, the critically acclaimed psychological thriller "Martha Marcy May Marlene" made $137,541 on four screens in New York and Los Angeles. That's a hefty $34,385 per screen average, according to Fox Searchlight.

Estimated ticket sales for Friday through Sunday at U.S. and Canadian theaters, according to Hollywood.com. Where available, latest international numbers are also included. Final domestic figures will be released Monday.

FDA: studies do not tie Chantix to mental problems

(AP) ? Federal health officials said Monday that Pfizer's anti-smoking drug Chantix did not increase psychiatric problems like depression and suicidal thoughts in two studies, though the findings are not definitive.

The Food and Drug Administration has been investigating reports of mood disorders and erratic behavior among Chantix patients since 2007. The agency said in a statement that two federally-funded studies involving more than 26,000 patients did not show an increased rate of psychiatric hospitalizations among Chantix patients, compared with those using nicotine patches and smoking cessation treatments.

FDA regulators stressed that the studies only recorded psychiatric problems that resulted in hospitalization, meaning many issues likely went unreported. Additionally, the studies by the Department of Veterans Affairs and the Department of Defense were not large enough to pick up very rare side effects.

Groups like the Federal Aviation Administration have already banned the drug for pilots and air traffic controllers due to side effects that could interfere with their work.

The agency said it is continuing to study the problems and recommends patients consult their doctors if they experience side effects with the drug. Pfizer is conducting its own large-scale study of Chantix behavioral effects, but the results won't be available until 2017.

"Healthcare professionals should advise patients and caregivers that the patient should immediately stop taking Chantix and contact a healthcare professional if agitation, hostility, depressed mood, or changes in behavior or thinking that are not typical for the patient are observed," the FDA said in an online statement.

More than 8.9 million people in the U.S. have filled prescriptions for Chantix since it was approved in May 2006. Last year Pfizer reported $755 million in sales for the drug, a decline of 14 percent since its peak sales of $883 million in 2007.

Shares of Pfizer Inc. rose 30 cents to $19.36, tracking broader increases on the S&P 500.

Chantix works by binding to the same spots in the brain that nicotine does when people smoke, blocking nicotine from those spots but causing release of a "feel-good" chemical, dopamine. The drug's label already carries a boxed warning, the most serious type, listing possible side effects including hostility, agitation, depression and suicidal thoughts and behavior.

New York-based Pfizer Inc. said in a statement: "We are reviewing this important information for smokers provided by the FDA."

Judge says no to Sprint request for AT&T documents (Reuters)

WASHINGTON (Reuters) ? Sprint Nextel lost a bid on Monday to get access to masses of AT&T documents that it had hoped to use in its lawsuit aimed at stopping AT&T's $39 billion acquisition of discount rival T-Mobile.

U.S. District Judge Ellen Huvelle also heard arguments about AT&T's request to dismiss the lawsuit brought by Sprint, but did not immediately rule.

Huvelle, who is hearing both the private antitrust case and the U.S. Justice Department's lawsuit to stop the deal, challenged Sprint's standing at least once during the hearing.

"You don't stand in the shoes of the consumer or the Department of Justice," she said.

The Justice Department in August sued to block the deal, which would vault No. 2 ranked AT&T into the leading position in the U.S. wireless market through the purchase of No. 4 operator T-Mobile, a unit of Deutsche Telekom AG.

Sprint, the No. 3 U.S. carrier, filed its own suit in September to block the deal. It complained that the mega-combination would harm its ability to obtain the latest handsets, reach roaming agreements and gain access to the market for backhaul services, links between the core network and more remote locations.

Verizon Wireless, a venture of Verizon Communications Inc and Vodafone Group Plc, is the current No. 1.

Sprint argued in court on Monday that it should have access to documents AT&T had already given to the Justice Department's antitrust division because it needs to build its own case.

At stake are AT&T's confidential documents, which likely provide an inside look at how the company views the deal with T-Mobile and how it conducts its business.

Sprint said AT&T currently has the upper hand because it already has documents that Sprint gave the Justice Department.

Huvelle declined to give Sprint the documents. "I don't see it as efficient or fair," said Huvelle, in denying the motion.

Bert Foer, head of the American Antitrust Institute, said the decision is good news for AT&T because Sprint would have given the Justice Department valuable help.

"There are ways in which Sprint can be exceptionally helpful to the government agencies and I'm sure that they will continue to provide advice but with more access to documents they're likely to provide better advice," Foer said.

UNUSUAL CHALLENGE

Huvelle also heard arguments about AT&T's request to dismiss the lawsuit brought by Sprint and another one brought by C Spire, the new name for Cellular South.

Speaking for Sprint, attorney Steven Sunshine argued that if AT&T was allowed to buy T-Mobile that Sprint would have increasing trouble making deals for handsets like Apple's iPhone.

"If this transaction goes forward, the plaintiffs will be impaired in their ability to compete," said Sunshine.

Huvelle did not give an indication of when she will rule on AT&T's motion to dismiss Sprint's lawsuit.

Sprint issued a statement later on Monday saying a competitor has standing if it demonstrates there is a plausible case it would be harmed by the proposed transaction's effect on the market. "We believe Sprint passed that test and we await the court's ruling."

Sprint's strategy is unusual in that competitors which fear mergers frequently complain vociferously to antitrust regulators but rarely file a lawsuit of their own.

Further, U.S. antitrust law is designed to protect consumers, rather than competitors, which means that courts would be expected to view a competitor's lawsuit skeptically.

Huvelle has set February 13 as the start date for trial of the government's case, and set aside up to six weeks for arguments. She will preside without a jury. The next status hearing will be on November 20.

A key government concern is that T-Mobile generally costs less than other carriers so its disappearance could mean higher prices for wireless service.

AT&T has defended the transaction, saying it would bring 5,000 overseas jobs back to the United States and enable it to expand high-speed wireless Internet coverage to 97 percent of all Americans.

AT&T has said it is keenly interested in reaching a settlement that would lead to Justice Department approval. The Justice Department has given no signs that it is interested in settling.

If the deal is abandoned, AT&T faces paying upward of $6 billion in cash and spectrum to T-Mobile.

The cases are USA v. AT&T, T-Mobile USA Inc and Deutsche Telekom AG, case No. 11-1560 and Sprint Nextel Corp v. AT&T Inc et al, No. 11-1600, and Cellular South v. AT&T, No. 11-1690. All the cases are before the U.S. District Court for the District of Columbia.

Children with certain dopamine system gene variants have an improved response to methylphenidate - the most commonly prescribed medication for Attention Deficit Hyperactivity Disorder - in a finding that could help eliminate the guesswork from prescribing effective medications for children with ADHD.

Researchers reporting their results in the Oct. 21 Journal of the American Academy of Child and Adolescent Psychiatry tested 89 children with ADHD between ages 7 and 11. They found that children with specific variants of the dopamine transporter (DAT) and dopamine receptor D4 (DRD4) genes showed greater improvement in hyperactivity and impulsivity after taking methylphenidate compared to children with alternative DAT and DRD4 versions.

"Physicians don't have a good way of predicting who will experience great improvement in ADHD symptoms with a particular medication, so currently we use a trial-and-error approach. Unfortunately, as a result, finding an effective treatment can take a long time," explained Tanya Froehlich M.D., lead investigator on the study and a physician in the division of Developmental and Behavioral Pediatrics at Cincinnati Children's Hospital Medical Center.

"With more information about genes that may be involved in ADHD medication response, we may be able to predict treatment course, tailor our approach to each child, and improve symptom response while decreasing health care costs," she added.

The study is the first-ever placebo-controlled pharmacogenetic drug trial for ADHD in school age children to evaluate the effects of dopamine system genes variants using teacher as well as parent ratings of children's symptoms. Given the importance of academic functioning for children with ADHD, Dr. Froehlich said it is crucial to consider medication impact at school as well as at home. Children in the study were not already taking stimulant medications for their ADHD.

Participants were prescribed one week each of placebo and three different doses of methylphenidate for their ADHD. Parents and teachers assessed and scored the children's behavioral symptoms based on the Vanderbilt ADHD Parent and Teacher Rating Scales.

The researchers analyzed DNA from saliva samples to see which ADHD-related gene types the children carried. They looked initially at four genes frequently implicated in ADHD ? DRD4, DAT, COMT and ADRA2A. DRD4 and DAT, the most well studied genes for ADHD, showed the strongest effects on methylphenidate dose-response in study participants, according to the researchers.

The DRD4 gene encodes the dopamine receptor protein, which helps control the synthesis and release of dopamine and the firing rate of neurons. The DAT gene encodes the dopamine transporter protein, which removes dopamine from the brain synapses.

Children who lack what is known as the DAT 10-repeat variant showed greater improvement after taking methylphenidate compared to those carrying the 10-repeat. Children without the DRD4 gene 4-repeat variant showed less symptomatic improvement with methylphenidate compared to 4-repeat carriers. A "repeat" is a short nucleotide coding sequences in a gene that is repeated.

Dr. Froehlich and her colleagues indicate in their study that although findings are promising, additional research is needed in larger patient samples to confirm current study findings and their clinical relevance.

AP-GfK Poll: Public down on economy, Obama cures

(AP) ? The extreme funk that settled over the country during the summer has eased slightly, but Americans remain gloomy about the economy and more than half say President Barack Obama does not inspire confidence about a recovery.

A sizable majority ? more than 7 in 10 ? believe the country is headed in the wrong direction and, in a new high, 43 percent describe the nation's economy as "very poor," according to a new Associated Press-GfK poll. Among those surveyed, less than 40 percent say Obama's proposed remedies for high unemployment would increase jobs significantly.

The pessimism is not a good sign for the nation's recovery hopes and presents a more urgent challenge for Obama as he mounts his re-election bid.

About 4 in 10 think unemployment will rise in the coming year; just 23 percent expect it to decrease. And few expect the government to be able to help. Only 41 percent say the government can do much to create jobs, and less than 40 percent say the main elements of Obama's jobs proposal would increase employment significantly.

What's more, expectations for the coming year have not improved, with 41 percent believing the economy will remain the same, 27 percent saying it will get worse and 30 percent saying it will improve.

In a glimmer of a bright spot, less than a quarter of those surveyed say they think the economy worsened in the past month, compared with nearly half who felt that way in August. And Obama could find some solace in the poll's finding that 44 percent place heavy blame for the economy's state on President George W. Bush, while 27 percent put the blame on him.

Still, the public's mood is decidedly downbeat, creating yet another obstacle to economic growth, which relies in part on public optimism to spur demand.

Illustrating Obama's precarious perch, 9 percent of survey respondents who said he deserves to be re-elected said they could vote for one of the three leading Republicans seeking the presidential nomination.

"If (GOP presidential contender Mitt) Romney and Obama were going head to head at this point in time I would probably move to Romney," said Dale Bartholomew, 58, a manufacturing equipment salesman from Marengo, Ill. Bartholomew said he agrees with Obama's proposed economic remedies and said partisan divisions have blocked the president's initiatives.

But, he added: "His inability to rally the political forces, if you will, to accomplish his goal is what disappoints me."

Despite the high number of people who believe the country is headed in the wrong direction, Obama himself gets some benefit of the doubt. His approval ratings are holding steady, with 46 percent approving of his job as president and 52 percent disapproving. Obama's standing with the public is weakest on the economy and in his efforts to tackle unemployment, with about 6 in 10 disapproving of his handling of both.

Obama's standing still vastly exceeds that of Congress. In a slight improvement, Congress' approval ratings rose from its August low of 12 percent to 16 percent. Still, 82 percent disapprove of Congress, including 56 percent who say they "strongly disapprove."

Little illustrates the decline in the public's faith in Obama more than the sharp dip in confidence he has experienced since the highs he enjoyed immediately after his election. Specifically, only 43 percent of the respondents say they are confident that Obama "will be successful in bringing about the changes needed to improve the economy," compared with 72 percent who said they were confident of his abilities in November 2008.

"I believe he is doing all he knows how, but it's just not working," said Ann Anderson, 49, a college administrator from Homer Glen, Ill.

Democrats tend to stick by the president, expressing much more confidence in his ability to turn the economy around. More than 7 in 10 say they are at least somewhat confident of his abilities to improve the economy. Among independents, 37 percent are that confident and only 11 percent of Republicans share that view.

Still, the disappointment in Obama extends to some Democrats who believe he should stand his ground.

"When Obama got elected I was real hopeful for a lot of changes," said Dave Buerger, 60, a part-time registered nurse from New Salisbury, Ind. "Overall I would say that I'm real disappointed in his concessions to the banks and Wall Street and the Republicans. I think he needs to be more liberal and stand his ground more. I think he's given in too much."

When it comes to compromise, 72 percent of respondents said Republicans were not doing enough to cooperate with Obama, whereas only 47 percent said Obama was not doing enough to cooperate with Republicans.

Even as the public expresses disappointment in Obama and disapproval of Congress, only 41 percent of respondents say the government can do quite a bit or a great deal to create jobs. Three out of 10 believe government's impact on jobs is moderate and 29 percent say it can help create little or no jobs at all.

Similarly, a majority of the public does not hold much hope for the job creation prospects of either Obama's $447 billion jobs proposal or for measures proposed by congressional Republicans.

Obama's plan to create jobs by increasing spending on public works projects such as schools, roads and bridges finds only 37 percent of respondents believing it will create a significant number of jobs. Tax credits to companies that hire those who have unemployed for six months or more elicits a similar response.

Only 27 percent of the respondents said a Republican proposal that reduces regulations on businesses would create a significant number of jobs; 45 percent say it would create few or no jobs.

The poll, however, found substantial support ? 62 percent ? for a proposal by Senate Democrats to pay for Obama's jobs proposal with a surtax on incomes over $1 million. One quarter of the respondents opposed the idea and 10 percent said they were neutral. Though the surtax has little or no chance of passing, the poll results underscore the view of Democrats that the proposal has political appeal.

Anderson, the college administrator from Illinois, voiced cautious support for the tax on millionaires.

"That's a tough call. Yes, I do, but that's only because I'm not one of them," she said. "Should they pay their fair share? Absolutely. Should they pay a certain percentage? I don't know how to answer that."

But Teresa Rowe, 53, a dance team consultant from Richland, Wash., said she preferred an overhaul of the entire tax system.

"They'll go after the millionaires first and then those slightly below millionaires. It's a slippery slope," she said. "They need to look at the entire tax system and revise the whole system."

The Associated Press-GfK Poll was conducted Oct. 13-17 by GfK Roper Public Affairs and Corporate Communications. It involved landline and cellphone interviews with 1,000 adults nationwide, and had a margin of sampling error of plus or minus 4 percentage points.

LONDON (AP) - Danish researchers can offer some reassurance if you're concerned about your cellphone: Don't worry. Your device is probably safe.
????? The biggest study ever to examine the possible connection between cellphones and cancer found no evidence of any link, suggesting that billions of people who are rarely more than a few inches from their phones have no special health concerns.
????? The Danish study of more than 350,000 people concluded there was no difference in cancer rates between people who had used a cellphone for about a decade and those who did not.
????? Last year, a separate large study found no clear connection between cellphones and cancer. But it showed a hint of a possible association between very heavy phone use and glioma, a rare but often deadly form of brain tumor. However, the numbers of heavy users was not sufficient to make the case.
????? That study of more than 14,000 people in multiple countries, in addition to animal experiments, led the International Agency for Research on Cancer to classify electromagnetic energy from cellphones as "possibly carcinogenic," adding it to a list that also includes things such as coffee and gasoline engine exhaust.
????? But that designation does not mean the phones necessarily pose a risk. Cellphones do not emit the same kind of radiation as that used in some medical tests or found in other sources such as radon in soil.
????? Two U.S. agencies - the Food and Drug Administration and the Federal Communications Commission - have found no evidence that cellphones are linked to cancer.
????? Yet fears of a link persist, despite the fact that cancer rates have not risen since cellphones were introduced.
????? In the latest research, published online Thursday in the journal BMJ, researchers updated a previous study examining 358,403 cellphone users aged 30 and over in Denmark from 1990 to 2007. They found cellphone users did not have a higher cancer risk compared with those without cellphones.
????? Cancer rates in people who used cellphones for about 10 years were similar to rates in people without a cellphone. Cellphone users were also no more likely to get a tumor in the part of the brain closest to where phones are usually held against the head. The study was paid for by the government's Danish Strategic Research Council.
????? "Our study provides little evidence for a causal association, but we cannot rule out a small to moderate increase in risk for subgroups of heavy users," said Patrizia Frei, of the Institute of Cancer Epidemiology in Copenhagen, Denmark, one of the paper's authors.
????? "This is encouraging news, but it doesn't mean we're at the end of the road," said Hazel Nunn, head of Health Evidence and Information at Cancer Research U.K., which was not linked to the study.
????? About three-quarters of the world's population, more than 5 billion people, use a cellphone. That makes it difficult for scientists to compare cancer incidence in people who use the devices versus those who do not.
????? Others disputed the Danish study's findings. The advocacy group MobileWise, which believes cellphones pose a health risk, said the study wasn't long enough to consider the long-term risk, since brain tumors can take decades to develop.
????? In an accompanying editorial in BMJ, Anders Ahlbom and Maria Feychting of Sweden's Karolinska Institute wrote that one of the study's strengths was its use of objective data from cellphone records. Previous studies have been criticized for relying on people to recall their cellphone habits from decades earlier.
????? In about 30 other studies done in Europe, New Zealand and the U.S., patients with brain tumors have not reported using their cellphones more often than unaffected people.
????? The editorial writers pointed out that research on cellphones and cancer was not sparked by any evidence of a connection, but from concerns that something about the relationship between radio frequency fields and human physiology had been "overlooked or misunderstood." Research into the safety of cellphones is now "extensive," they wrote.
????? Nunn said studies with longer-term data were still needed and that there was little information on children's exposure to cellphones.
????? There was no biological evidence for how cellphones might cause cancer, unlike, for example, the proof that tobacco is carcinogenic, she added.
????? Cellphones send signals to nearby towers via radio waves, a form of energy similar to microwaves. But the radiation produced by cellphones cannot directly damage DNA and is different from stronger types of radiation like X-rays or ultraviolet light. At very high levels, radio frequency waves from cellphones can heat up body tissue, but that is not believed to damage human cells.
????? Nunn said people should not change their cellphone habits based on the current evidence, except perhaps for limiting their kids' use of the devices.
????? "There are a lot more worrying things in the world than mobile phones," she said.

HOUSTON -- (Oct. 19, 2011) -- A review of the genetic and biochemical abnormalities associated with autism reveals a possible link between the widely diagnosed neurological disorder and Type 2 diabetes, another medical disorder on the rise in recent decades.

"It appears that both Type 2 diabetes and autism have a common underlying mechanism -- impaired glucose tolerance and hyperinsulinemia," said Rice University biochemist Michael Stern, author of the opinion paper, which appears online in this month's issue of Frontiers in Cellular Endocrinology.

Hyperinsulinemia, often a precursor to insulin resistance, is a condition characterized by excess levels of insulin in the bloodstream. Insulin resistance is often associated with both obesity and Type 2 diabetes.

"It will be very easy for clinicians to test my hypothesis," said Stern, professor of biochemistry and cell biology at Rice. "They could do this by putting autistic children on low-carbohydrate diets that minimize insulin secretion and see if their symptoms improve."

Stern said the new finding also suggests that glucose tolerance in pregnant women may need to be addressed more seriously than it is now.

Stern said he first realized there could be a common link between Type 2 diabetes and autism a few years ago, but he assumed someone else had already thought of the idea.

Stern's lab, which is located at Rice's BioScience Research Collaborative, specializes in investigating the genetic interactions associated with genetic diseases like neurofibromatosis, a disorder in which patients are several times more likely to be afflicted with autism and autism spectrum disorders (ASD) like Asperger's syndrome.

Autism and ASD are neurological disorders that have a strong but poorly understood genetic basis. The U.S. Centers for Disease Control and Prevention estimates that about nine out of 1,000 U.S. children are diagnosed with ASD.

Stern said at least four genes associated with increased frequency in autism are known to produce proteins that play key roles in a biochemical pathway known as PI3K/Tor. Stern said he had been studying a form of abnormal function in the synapses of fruit flies that was remarkably similar to abnormalities observed in rats and mice with defects in a different pathway known as mGluR-mediated long-term depression.

"I had also spent a lot of time thinking about insulin signaling because another project in my lab is an endocrinology project in which we're studying how key proteins involved in insulin signaling affect the timing of metamorphosis in fruit flies," Stern said.

From his studies in both areas, Stern knew two things: PI3K/Tor was the major pathway for insulin signals within cells, and insulin could affect synapses in a remarkably similar way to the mGluR defects associated with autism.

"When I read that the incidence of autism was increasing, and combined that with the fact that the incidence of Type 2 diabetes is also increasing, it seemed reasonable that each increase could have the same ultimate cause -- the increase in hyperinsulinemia in the general population," Stern said. "I didn't do anything with this notion for a few years because it seemed so obvious that I figured everyone already knew this hypothesis, or had tested it and found it was not true."

Stern said he changed his mind a few months ago when a health care consulting firm asked him to provide input about autism.

"In preparing for this interview, I discovered that gestational diabetes was the most important identified maternal risk factor for autism, but that 'no known mechanism could account for this,'" Stern recalled. "When I read this, I was speechless. That's when I realized that this was not obvious to others in the field, so I decided to write this up with the hope that clinicians might become aware of this and treat their patients accordingly."

In writing the article, Stern said he learned that the role of insulin in cognitive function is becoming more widely accepted.

"I was checking to see if insulin was known to affect synaptic function, and I learned that the nasal application of insulin is already being tested to see if it is beneficial for both Alzheimer's and schizophrenia."

Stern said he also found preliminary studies that indicated that low-carb diets were therapeutic for some individuals with autism and ASD.

"Based on what's already in the literature, insulin needs to be taken seriously as a causative element in autism," Stern said. "I hope that clinicians will take the next step and put this to a rigorous test and determine how to best use this information to benefit patients."
